I'm a Beneficiary dealing with a Bad Trustee
My Story is simple. My parents worked hard to provide a comfortable life for us, their children. I have always been hard working just like my parents. However, my brother (a.k.a. The Bad Trustee) thinks of himself as a Trust Fund Kid and is stealing, lying and perjured himself to the court in an attempt to hide Trust assets.
The Slow Legal Process is Painful

6/10/2025:
The Bad Trustee Attorney blatantly lied to the court that “their is no desprepency about the numbers” and mischaratered the conversion with my attorney. I’m afraid that the Bad Trustee, Bad Trustee’s Attorney and the Bad Trustee’s Wife have put themselves in SERIOUS legal jeapordy.
The Judge advised that this small amount of money could become a large amount of money if we go to trial, which is now set for later this year.
6/7/2025:
It’s nearly time for our next probate hearing and the Judge is not going to be happy that mediation failed yet again because of the Bad Trustee’s insincere and unreasonable efforts to make any sort of attempt to resolve. So, it’s likely that we will now be set for trial. Actually, this is very relieving to me because now it’s time to start introducing evidence and I have volumes of damming evidence and the Bad Trustee and the Bad Attorney have no answers for missing money, lies and many inconsistencies. 5/29/2025:
This situation seems to be getting worse for the Lying Trustee and his Lying Attorney. The “Trust” Attorney has no explanation for the missing cash and has said he would send my attorney a spreadsheet and more information. They had better hurry-up because we have our next update hearing for the Probate Judge coming soon and he’s NOT going to be happy that mediation didn’t happen after all these months. I’ve been so disappointed that we can’t move this along quicker but I guess the justice system just moves slowly. This time has allowed us to produce much evidence so as long as their is reason and fairness, then the Trustee is toast.
5/9/2025:
The Bad Trustee’s attorney told another lie to my attorney about the Cash In Account which is missing nearly $400k from an already fraudulent First Accounting. The nerve to tell such blatant and provable lies is simply stunning but thus far, they have not had to answer any direct questions or be accountable so they’ve certainly been emboldened.
2/10/2025:
The Bad Trustee and his wife admitted the $430k home loan verbally and on email, but the financial damage has been done with his lie. The Trustee has paid lots of his legal fees to fight his personal lie and I’ve had to absorb massive attorney’s fees to finally get him to admit this truth. Even now I expect this to be a battle because the Bad Trustee’s attorney seems to want to keep fighting that the home loan is not a Trust Payback. I can’t believe what’s happening and they aren’t in jail. When the time comes, I will have no pity for any of them because of the constant lies in spite of me giving every opportunity for them to correct their lies.
12/9/2024:
The Bad Trustee and his attorney continue to play games and simply won’t total the assets and split 50/50, so in yet another effort to compromise, I provide a ‘demand settlement’ which is basically my settlement terms. I should’t have to do this, but I wanted to, again, so my willingness to compromise. This whole process is really backwards and from everything I’ve read the Trustee is supposed to be forthcoming and honest. Yet, in my case this has been a constant catch-me-if-you-can.
4/10/2024:
The Bad Trustee provided a Second Accounting for CY2023 and devalued one of his in-kind properties from the appraised value of $450k to $337k from a Zillow search! Can you believe it? Of course my attorney questioned this in our petition to the court, but there is nothing done to address this.
4/26/2023:
The Bad Trustee submitted a sworn Declaration to the court under the Penalty of Perjury that he did not induce contest for me to sign the A/B split without properly funding the Bypass Trust as ordered in the Irrevocable Trust documentation. He’s now using this as a reason not to provide information entitled to me. I have several email and text messages that prove, without a shred of doubt, that he did, indeed induce consent. This is supposed to be one of the worst things a Trustee can do.
3/30/2023:
The Bad Trustee provided a 1st Accounting and excluded a $430k home loan after he and his wife admitted this loan as a trust payback! He is now guilty of embezzlement.
